簡(jiǎn)介:西南政法大學(xué)碩士學(xué)位論文職業(yè)化理念下的職業(yè)化理念下的美國(guó)法學(xué)美國(guó)法學(xué)教育教育兼論兼論對(duì)中國(guó)法學(xué)教育改革的啟示對(duì)中國(guó)法學(xué)教育改革的啟示導(dǎo)師付子堂師付子堂教授教授作者黃靜雅者黃靜雅專業(yè)法學(xué)理論業(yè)法學(xué)理論中國(guó)中國(guó)重慶重慶二○○○○八年四月1內(nèi)容摘內(nèi)容摘要在中國(guó)法學(xué)教育跨世紀(jì)發(fā)展、改革之時(shí),借鑒和學(xué)習(xí)其他法學(xué)教育發(fā)達(dá)國(guó)家的經(jīng)驗(yàn)是尤其重要的。審視法學(xué)教育發(fā)展歷史悠久、制度完備的美國(guó),我們對(duì)其法學(xué)教育制度中錯(cuò)綜復(fù)雜的各個(gè)方面的研究還遠(yuǎn)遠(yuǎn)不夠。我國(guó)模仿美國(guó)的法律博士(JURISDOCT)教育制度,設(shè)立了法律碩士教育制度,但是對(duì)于法律博士學(xué)位設(shè)置的機(jī)制卻不盡了解,各種觀點(diǎn)對(duì)其學(xué)術(shù)等級(jí)價(jià)值以及它與其他學(xué)位的內(nèi)在差別也存在著爭(zhēng)議。我國(guó)的教育評(píng)估制度與美國(guó)法學(xué)院的專業(yè)認(rèn)證制度設(shè)計(jì)的初衷是一致的,但是運(yùn)行后的成果卻不盡相同。在尋求相對(duì)完善的中國(guó)法學(xué)教育制度的時(shí)候,我們應(yīng)該注意向國(guó)外學(xué)習(xí),促成國(guó)外先進(jìn)法學(xué)教育制度與本國(guó)國(guó)情的結(jié)合,探求這樣一種結(jié)合即成為本文的目的所在。當(dāng)中國(guó)的法學(xué)院開始面對(duì)挑戰(zhàn),改革法學(xué)教育體制以便適應(yīng)法律發(fā)展中的當(dāng)代問題以及全球化發(fā)展趨勢(shì)之時(shí),我們將不可避免地遇到許多問題。對(duì)于這些問題,只有通過認(rèn)真思考那些發(fā)達(dá)地區(qū)如何創(chuàng)立其法學(xué)學(xué)位課程并使其得以發(fā)展的過程,才能得到很好的理解。要達(dá)到改革的目標(biāo),中國(guó)的法學(xué)院不能僅簡(jiǎn)單地模仿或移植國(guó)外的法學(xué)學(xué)位課程,更關(guān)鍵的是從理念的層面上去理解美國(guó)的法學(xué)教育,為法學(xué)學(xué)位課程的設(shè)置與培養(yǎng)目標(biāo)定位給予有意義的指導(dǎo)。本文審視了中國(guó)和美國(guó)法學(xué)教育體制,對(duì)兩國(guó)法學(xué)教育中的缺點(diǎn)都給出了客觀、公正的討論,以便在日后的改革中選擇性地吸收和借鑒美國(guó)的經(jīng)驗(yàn)。本文約35000字,由五部分構(gòu)成。第一部分從法律職業(yè)培訓(xùn)、大學(xué)法學(xué)教育及法學(xué)教育現(xiàn)狀三個(gè)方面回顧了美國(guó)法學(xué)教育的歷史與發(fā)展。職業(yè)化教育的發(fā)展趨勢(shì)始終是美國(guó)100多年法學(xué)教育發(fā)展中的主線。第二部分審視分析了美國(guó)的法學(xué)職業(yè)教育,即法律博士的教育。本部分闡述了法律博士學(xué)位在美國(guó)的創(chuàng)設(shè)過程及分析了它的學(xué)位等級(jí)及國(guó)外法學(xué)界的相關(guān)爭(zhēng)論,強(qiáng)調(diào)了中國(guó)法學(xué)院對(duì)美國(guó)模式模仿的可行性。相關(guān)的問題是美國(guó)法律博士學(xué)位的等級(jí)與相應(yīng)的法學(xué)學(xué)位。本章對(duì)一些問題,例如法律博士學(xué)位是不是真正意義上的博士學(xué)位、美國(guó)以外的法律界是如何看待法律博士學(xué)位,做出了解答。

簡(jiǎn)介:西北師范大學(xué)碩士學(xué)位論文中等職業(yè)學(xué)?!坝唵问浇逃爆F(xiàn)狀及對(duì)策研究姓名劉紅英申請(qǐng)學(xué)位級(jí)別碩士專業(yè)教育指導(dǎo)教師王鑒20050101摘要職業(yè)教育是與經(jīng)濟(jì)建設(shè)聯(lián)系最直接、最緊密的教育,抓經(jīng)濟(jì)必須抓職教,抓職教就是抓經(jīng)濟(jì)。中職教育是一重要的職教層次,但是改革開放特別是進(jìn)入20世紀(jì)90年代以來,在高等教育不斷發(fā)展的過程中,中職教育不僅沒有得到發(fā)展,卻處于生存的困境一是招生規(guī)模銳減;二是生源質(zhì)量日益下降;三是社會(huì)對(duì)畢業(yè)生的認(rèn)可度低。伴隨我國(guó)市場(chǎng)經(jīng)濟(jì)體制的逐步完善和職教改革的迅猛發(fā)展,一種新的人才培養(yǎng)模式一一“訂單式教育”模式,在各地悄然興起。所謂“訂單式教育”模式,就是學(xué)校和企業(yè)共同制定人才培養(yǎng)計(jì)劃、簽訂用人合同、利用雙方的資源、共同負(fù)責(zé)招生、培養(yǎng)和就業(yè)全過程的合作辦學(xué)模式。“訂單式教育”體現(xiàn)了市場(chǎng)經(jīng)濟(jì)條件下人力資源開發(fā)與利用的規(guī)律,昭示了職業(yè)教育改革的方向,是實(shí)行產(chǎn)教結(jié)合、校企合作辦學(xué)的有效途徑,是提高職業(yè)教育人才培養(yǎng)水平,提高人力資源開發(fā)和利用的嘗試,是幫助中職學(xué)校走出辦學(xué)困境的有效途徑。新疆的中職教育由于歷史、地域、及經(jīng)濟(jì)等原因,和內(nèi)地一些職業(yè)院校相比呈明顯的滯后性。中職教育的“訂單式教育”模式在新疆才剛剛起步,新疆農(nóng)墾中專正在實(shí)施職業(yè)教育改革,嘗試“訂單式教育”,本研究對(duì)新疆農(nóng)墾中專學(xué)校26個(gè)教學(xué)班進(jìn)行“訂單式教育”現(xiàn)狀調(diào)查發(fā)現(xiàn),我校的“訂單式教育”存在以下不足其一,“訂單式教育”只停留在協(xié)議中;其二,在實(shí)施“訂單式教育”的過程中,為了抓住“訂單”,解決企業(yè)的用人之急,讓“訂單”學(xué)生過多過早地參與企業(yè)的生產(chǎn)經(jīng)營(yíng)活動(dòng),追求虛假的就業(yè)率其三,進(jìn)入“訂單式教育”班級(jí)的學(xué)生高枕無憂,學(xué)校對(duì)“訂單式教育”的畢業(yè)生跟蹤調(diào)查不夠。針對(duì)以上癥結(jié),本次研究提出了一些解決問題的對(duì)策首先,要加強(qiáng)校企之間的溝通與協(xié)作,學(xué)校應(yīng)與企業(yè)協(xié)商,共同制定人才培養(yǎng)方案,要求企業(yè)參與“訂單式教育”教學(xué)的全過程,特別是實(shí)踐教學(xué)過程離不開企業(yè)的參與,使培養(yǎng)出來的學(xué)生完全符合定向企業(yè)的要求,以求長(zhǎng)期合作,而非眼前利益。第二,建設(shè)一支適應(yīng)“訂單式教育”的師資隊(duì)伍,“訂單式教育”是一種具有中國(guó)特色的CBE教育模式,它注重學(xué)生實(shí)踐能力的培養(yǎng),要求我們的教師必須是“雙師型”的教師。第三,不斷深化對(duì)中等職業(yè)技術(shù)教育的綜合改革。只有這樣,才能把“訂單式教育”人才培養(yǎng)目標(biāo)落到實(shí)處,辦出自己的職教特色,使“訂單式教育”這種新型的辦學(xué)模式更趨于科學(xué)、實(shí)用,更受企業(yè)的歡迎。關(guān)鍵詞中等職業(yè)學(xué)?!坝唵问浇逃睂?duì)策II
